We welcome you to the Realitywave websites and theRealitywave mobile application and any materials and services you may find therein (individually called the "Site" or collectively called the "Sites"), which are operated by (company name). We (company name)" or "we" or "us" (subsidiaries).

The Terms govern the use of the Sites and constitute a legally binding contract between you and Realitywave. Realitywave may post additional terms and conditions through the Sites or make them available to you in other ways.

We may collect and use information about users and viewers of the Sites through our Privacy Policy ("Policy").

REVIEW THESE TERMS AND POLICIES CAREFULLY. BY ACCESSING OR USING THE SITES, YOU AGREE TO THESE TERMS AND POLICIES AND CONSENT TO BE BOUND BY THEM. YOU MUST NOT USE OR ACCESS THE SITES IF YOU DO NOT ACCEPT OR CONSENT TO BE BOUND BY THESE TERMS AND POLICIES.

The Terms and/or Policy may be changed from time to time by notifying you of such changes by any reasonable means, including by posting revised Terms or Policy through the Sites. We will not be liable for disputes between you and us before we post the revised Terms or Policy or otherwise notify you of the changes.

If these Terms and/or Policy conflict with any other applicable terms or agreements fully executed by you and Realitywave ("Other Terms"), the Other Terms shall govern. The "Last Updated" legend above indicates when these Terms were last updated. Our Sites may be modified or discontinued at any time and without notice (including access to the Sites via any third-party links), or we may offer opportunities to some or all Site users. The revised Terms will become effective when they are posted on the Sites. Following these changes, you agree to the revised Terms using the Sites.

There is no legal representation provided by Realitywave. No law firm exists among the project attorneys on Realitywave.

  • ELIGIBILITY

    You affirm that you are of legal age to enter into these Terms by using the Sites. If you are an individual accessing or using the Sites on behalf of, or You agree to these Terms on behalf of yourself and any corporation, partnership or other entity with which you are affiliated (an "Organization"). You also represent and warrant that you have the legal authority to bind such Organization to these Terms.

  • LICENSE

    It is the sole responsibility of Realitywave to grant you a limited, non-exclusive, non-transferable, non-assignable, revocable license to access and use the Sites and download any materials made available for download on the Sites, but only for your personal and non-commercial use.

    Realitywave or its suppliers own all content, information, and materials on the Sites, which are protected by Indian and international laws. You are not permitted to access or use the Sites or any content, information, or materials available except as expressly permitted by these Terms.

    All trademarks, service marks, and logos displayed on the Sites (the "Marks") belong to Realitywave or their respective third parties. We don't give you any rights to the Marks except the right to view them. No license or right to use the Marks displayed on the Sites is granted by implication, estoppel, or otherwise.

  • USER-SUBMITTED MATERIALS

    You can upload your résumé and/or other jobs- and career-related information to the Sites, and you may also be able to submit comments and materials through interactive features like message boards and other forums, chatting, commenting, and other messaging tools (all of these things are called "Submitted Materials"). To be clear, you still own the materials you send in. You give Realitywave a worldwide, royalty-free, fully paid-up, non-exclusive, perpetual, irrevocable, transferable, and fully sublicensable (through multiple tiers) license without additional payment to you or any third party to reproduce, distribute, perform and display (publicly or otherwise), create derivative works of, adapt, modify, and otherwise use and profit from such Submitted Materials, in any format or media now known or hereafter developed, and f. (including promotional purposes, such as testimonials).

    We will also consider any ideas, proposals, suggestions, or other materials you send us ("Feedback") as Submitted Materials, whether relating to the Sites or not. You acknowledge and agree that your Feedback will not be confidential, that you are providing such Feedback gratuitously, unsolicited, and without restriction, and that no fiduciary or other obligation is placed on Realitywave. This section grant licenses to you based on your representation and warranty that you have all the rights necessary to do so. Your Submitted Materials, and the provision of them through the Sites and in connection in addition to that, are complete and accurate, do not violate any applicable law or third party rights or are fraudulent, tortious or otherwise unlawful.

    A waiver of any "moral rights" or other rights you may have in respect of attribution of authorship or integrity of materials regarding each Submission is irrevocable. Realitywave may (but is not obligated to) screen, monitor, evaluate and remove any Submitted Materials at any time, or analyze your access and use of the Sites. We can give anyone information about your access to and use of the Sites and the circumstances surrounding those accesses and uses.

    Please note that some information you give to Realitywave through the Sites may also be governed by Realitywave 's Privacy Policy. Whenever you provide information to the Sites, you represent and warrant that it is accurate, complete, and up-to-date.

  • RULES OF CONDUCT

    You agree not to:

    Materials that are or may be:

    • Threatening, harassing, degrading, hateful or intimidating, or fail to respect the rights and dignity of others.
    • Defamatory, libelous, fraudulent or otherwise tortious.
    • Obscene, indecent, pornographic or otherwise objectionable.
    • Protected by copyright, trademark, trade secret, right of publicity or privacy or any other proprietary right, without the express prior written consent of the applicable owner.

    Use the Sites for any commercial or for any fraudulent or tortious or unlawful purpose. Interfere with or disrupt the operation of the Sites or the servers used to make the Sites available, including by hacking or defacing any portion of the Site; or violating any requirement, procedure or policy of such servers or networks. Reproduce, modify, adapt, translate, create derivative works of, sell, rent, lease, loan, timeshare, distribute or otherwise exploit any portion of (or any use of) the Sites except as expressly authorized herein.

    Reverse engineer, decompile or disassemble any part of the Site, except where such restriction is expressly prohibited by applicable law.

    Frame or mirror any portion of the Sites or otherwise incorporate a portion of the Sites into any product or service. Use spiders to copy materials from the Sites to make publicly available, searchable indices of such materials. Realitywave reserves the right to revoke such permission at any time and without notice.

  • THIRD-PARTY MATERIALS

    You may find links to third-party websites, content, services, or information on the Sites ("Third Party Materials"). We do not control and are not responsible for these Third Party Materials. The availability of these Third Party Materials on the Site does not imply endorsement or affiliation with their providers. You are responsible for your use of Third Party Materials.

  • INDEMNIFICATION

    You agree to indemnify, defend, and hold harmless the website and its affiliates from any claims, liabilities, damages, awards, losses, costs, expenses and fees (including attorneys' fees) arising out of or relating to your access to, or activities in connection with, the Sites (including any Submitted Materials), or your violation or alleged violation of these Terms or the Privacy Policy. This indemnity obligation shall survive the termination of this Agreement.

  • DISCLAIMER

    OUR SITES ARE PROVIDED AS IS AND AVAILABLE WITHOUT ANY WARRANTIES OF ANY KIND.

    The Realitywave disclaims all warranties, whether express or implied, with respect to the sites to the fullest extent permitted by law, including warranties of merchantability, fitness for a particular purpose, non-infringement, title, and warranties arising from performance, dealings, or usage or trade.

    The Sites are updated, complete, accurate, and secure, but we do not guarantee that they will remain so or that access to the Sites will be uninterrupted. There may be a number of errors, inaccuracies, and materials on the Sites that violate or conflict with these Terms. The Sites may also be altered unauthorized by third parties.

    Further, without limiting the foregoing, Realitywave:

    • Does not guarantee that you will receive any employment or job offers through the Sites.
    • Will not be responsible for any employment offers or listings, employment screenings, employment decisions, or employment presented by third parties.
    • Is neither your employer nor your agent based solely on your usage of the Sites. You are not guaranteed to receive any employment or job offers through the Sites. You must use your judgment when evaluating prospective employers or Third Party Materials.

  • LIMITATION OF LIABILITY

    YOU AGREE REALITYWAVE WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES OF ANY KIND, WHETHER UNDER A CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHER THEORY, INCLUDING DAMAGES FOR LOSS OF PROFITS, USE OR DATA, LOSS OF OTHER INTANGIBLES, OR LOSS OF SUBMITTED MATERTERSE (INCLUDING UNAUTHORIZED INTERCEPTION BY THIRD PARTICIPANT SUBMITTED.

    REALITYWAVE WILL NOT BE LIABLE FOR DAMAGES OF ANY KIND RESULTING FROM YOUR USE OF THE SITES OR YOUR INABILITY TO USE THIRD-PARTY MATERIALS, INCLUDING ANY MALWARE, VIRUS, WORM, HACK, OR MALICIOUS SOFTWARE THAT MAY BE TRANSMITTED IN CONNECTION WITH THEM.

    IF YOU ARE UNSATISFIED WITH THE SITES, YOU AGREE TO STOP USING THE SITES AS YOUR SOLE AND EXCLUSIVE REMEDY. FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, THE MAXIMUM AGGREGATE LIABILITY OF REALITYWAVE WILL BE $100.

  • TERMINATION

    Realitywave may terminate or suspend your access to the Sites at any time, with or without notice. Your right to access and use the Sites will immediately cease; you may immediately deactivate or delete your user name, password and account. The remaining provisions of these Terms will survive and continue in effect.

  • GOVERNING LAW; JURISDICTION

    The Terms will be construed under the laws of the state (a) where you use or access the Sites or (b) if a dispute arises relating to your consideration for hire or your hiring, the state where the job opportunity is located.

  • GENERAL

    These Terms do not, and will not be construed to, create any partnership, joint venture, employer-employee, agency or franchisor-franchisee relationship between you and Realitywave.

    If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be deemed severable. It will not affect the validity and enforceability of any remaining provision.

    No waiver by either party of any breach or default under these Terms will be deemed a waiver of any preceding or subsequent breach or default. These Terms, including any terms and conditions incorporated herein, constitute the entire Agreement between you and Realitywave relating to the subject matter hereof and supersede any and all prior or contemporaneous written or oral agreements or understandings between you and Realitywave relating to the such subject matter.

    Notices to you (including notices of changes to these Terms) may be made via posting to the Sites or by email (including in each case via links), or by regular mail.

  • ACCOUNT AND PASSWORD

    You, and not Realitywave, are responsible for the security of and any use or misuse of your username or password. Your sole responsibility is to maintain the confidentiality of your account login and password. We may reject, or require that you change, any username, password, or other information you provide to us in registering.

  • CUSTOMERS

    The Sites are available to customers of Realitywave ("Customer"). As soon as you have registered, you may be able to:

    • Orders should be created;
    • The review and modification of existing orders;
    • Review each order's details, including Candidate information;
    • Your contact information needs to be updated;
    • Check out the Candidate recommendations;
    • Approve time reports for Realitywave personnel on assignment.

    The Customer is solely responsible for all activities undertaken within his or her account, including but not limited to any charges and additional fees incurred for extending or otherwise modifying assignments.

  • Payments Through the Sites

    Your Transaction may require you to provide certain information. You must provide your bank routing number, bank account number, credit card number, the expiration date of your credit card, billing address, billing phone number, and email address. The Sites may ask for such information if you want to pay an outstanding invoice.

    YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY BANK ACCOUNT INFORMATION OR CREDIT CARD(S) OR OTHER PAYMENT METHOD(S) UTILIZED IN CONNECTION WITH ANY TRANSACTION.
